Metalonic Artist Agreement

This Metalonic Artist Agreement (the "Agreement") incorporates our [Terms of Service](https://www.metalonic.com/policies/terms-of-service) (the "Terms") and [Privacy Policy](https://www.metalonic.com/policies/privacy-policy). It governs your activities as an Artist on our platform, including submitting artworks and offering products for sale to customers. **PLEASE READ THIS AGREEMENT CAREFULLY**, as it establishes our legal relationship and imposes binding obligations on both parties.

1. Agreement to Terms
This Agreement applies to individuals participating as Artists on our platform. By becoming an Artist, you may create a gallery, showcase artworks, and sell products. To do so, you must:
- Register as a user.
- Complete the artist application process or accept an invitation.
- Agree to this Agreement.

Your consent to this Agreement is indicated when you complete the artist registration process or by other methods we may specify. Updates to this Agreement will take effect upon your acceptance.

2. Eligibility
- **Age Requirements:** You must be at least 18 years old to become an Artist.
- **Minors:** If aged 16–18, you may use a parent/guardian’s account with their permission. They must supervise your activity and assume responsibility for your use of the platform.

3. Responsibilities
You must comply with our Terms, content guidelines, and applicable laws. Metalonic reserves the right to remove or request edits to any content violating these standards. Non-compliance may result in content removal or account termination.

4. Pricing and Payments
Metalonic charges a flat fee or percentage of product sales and pays the remaining balance (your "earnings") to you, minus taxes, fees, and applicable discounts. Key payment terms include:
- **Pending Earnings:** Earnings are held for 30 days to process refunds or changes.
- **Withdrawal Threshold:** Withdraw earnings of $100+ via the platform or request support for smaller amounts.
- **Prohibited Payments:** No earnings are provided for content violating our Terms or applicable laws.

5. Promotions and Marketing Use of Your Content
By participating as an Artist, you grant Metalonic a non-exclusive, sublicensable, and transferable license to use your uploaded artworks and product photos to market and promote the Metalonic platform, including on social media, newsletters, and advertising. Such uses do not constitute copyright infringement, and you will not receive royalties or earnings for these promotional activities.

6. Intellectual Property and Copyright Responsibility
By submitting your artworks, you grant Metalonic a license to:
- Produce and sell products based on your artworks.
- Market and promote the platform using your artworks.
- Use artworks for other business purposes as described in this Agreement.

You retain ownership of your artworks except for the rights explicitly granted herein. You represent and warrant that:
- You own or have proper authorization to use and distribute your artworks.
- The artworks do not infringe upon third-party intellectual property rights or violate applicable laws.
- If an artwork depicts a person, you have obtained their consent for the use of their image.

**Responsibility for Copyright Compliance:**
It is the sole responsibility of the Artist to ensure that submitted artworks do not infringe on any third-party copyrights or intellectual property. Metalonic assumes no liability for any legal claims related to copyright violations or unauthorized use of content.

7. Prohibited Activities
Artists must not:
- Submit infringing or unauthorized content.
- Misrepresent ownership of artworks.
- Use automated tools to manipulate platform metrics.
- Sell Metalonic-branded products outside the platform without authorization.

Violations may result in account suspension or termination.

8. Termination
- Artists may terminate their participation by contacting support.
- Metalonic reserves the right to terminate accounts for violations of this Agreement, our Terms, or laws.

Upon termination, artworks and products will be removed, though archival copies may be retained for legal or administrative purposes.

9. Indemnification
You agree to indemnify Metalonic against claims, losses, or liabilities arising from:
- Your artworks or products.
- Violations of this Agreement or applicable laws.
- Disputes with customers or third parties.

10. Miscellaneous
This Agreement, along with our Terms and Privacy Policy, represents the entire agreement between you and Metalonic. If any provision is found unenforceable, the remainder will remain valid.

By agreeing to this Agreement, you confirm that you have read, understood, and accepted its terms.
